CITY ATTORNEY ARGUES ZD SHOULD HAVE BEEN EJECTED FROM COUNCIL MEETING FOR CALLING ALARCON "ONE OF SHADIEST" -- THEN HE GETS INDICTED 32 TIMES, STRENGTHENING ZD'S ARGUMENT...DOH & LOL!

In order to voice their concerns over the (Venice Beach) ordinance and its enforcement, Plaintiffs Dowd and Dogg began attending Los Angeles City Council meetings and speaking during public comment sessions.

Plaintiffs Dowd and Dogg raise facial and as-applied challenges to the City Council's Rules of Decorum.

Plaintiffs argue that the Rules-- which prohibit making "personal, impertinent, unduly repetitive, slanderous, or profane remarks" and "utter[ing] loud,
threatening, personal or abusive language"-- "are content based, vague, and thus do provide for discretionary enforcement based on subjective analysis by the City Council members." (Compl. ~ 58.)

Dogg raises an as-applied claim because he was
ejected from the same meeting after stating during public comment that one member of the Council was "one of the most shadiest, most troublesome, problematic council members in the history of the city itself."

[CITY CAN'T CATCH A BREAK, CAUSE THEY ARE TOO DUMB AND ARROGANT FOR THEIR OWN GOOD. First, they are appealing an award over their Venice ordinance filed by Mike Hunt & Matt Dowd (which included Zuma Dogg for his T-shirts) in 9th Circuit Appeals court, THIS WEEK, after a jury ALREADY AWARDED HUNT/DOWD $500,000; plus $250,000 in attorney fees, for a total of $750,000 ALREADY PLACED IN A FEDERAL ESCROW ACCOUNT as required by a Federal Judge. SINCE THE CITY DECIDED TO APPEAL THE JURY AWARD DECISION -- THE 9TH CIRCUIT MADE A RULING THAT WEAKENS THE CITY'S ARGUMENT. (DOH!)

AND, to make matters worse for the city regarding ZD's "Code of Conduct" ejection from chambers for calling Alarcon "ONE" of the "shadiest....in city history," -- HE WAS INDICTED 32 TIMES and NO OTHER COUNCILMEMBER has been indicted. So not only is the speech itself going to be deemed as "ok" (shouldn't have been ejected in the first place) - but now the city will have to fight that argument having the ONLY CM you accuse Zuma Dogg of breaking conduct code over -- is ONLY elected official in the city indicted a WHOPPING 32 times. DOH!

The city refuses to break their stubborn habits and therefore, Schleprock luck.
